I. Acceptance of Terms

By accessing, browsing, or placing an order through the Maison Soire website ("Site"), you acknowledge that you have read, understood, and agree to be legally bound by these Terms of Service ("Terms"), our Refund & Return Policy, our Privacy Policy, and any additional policies referenced herein. If you do not agree to these Terms in their entirety, you must immediately discontinue use of this Site.

These Terms constitute a binding legal agreement between you ("Customer," "you," or "your") and, Maison Soire ("Maison Soire," "we," "us," or "our"), a limited liability company.

You represent and warrant that you are at least 18 years of age and possess the legal authority to enter into this agreement. If you are accessing this Site on behalf of a business entity, you represent that you have the authority to bind that entity to these Terms.

II. Products & Descriptions

Maison Soire makes reasonable efforts to display product colors, textures, and details as accurately as possible. However, we cannot guarantee that your device's display will render colors with absolute accuracy. Slight variations in color, sheen, and texture between what is displayed on-screen and the physical product are inherent to both digital displays and natural silk, and do not constitute grounds for a return, exchange, refund, or claim of misrepresentation.

All product descriptions, dimensions, and specifications are provided for informational purposes and are subject to change without notice. Maison Soire reserves the right to modify, discontinue, or limit the availability of any product at any time without prior notice or liability.

The inclusion of any product on this Site does not constitute an offer to sell. We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, pricing errors, suspected fraud, or violations of these Terms.

III. Pricing & Payment

All prices displayed on the Site are in United States Dollars (USD) unless otherwise stated. Prices are subject to change without notice. Maison Soire reserves the right to correct any pricing errors at any time, even after an order has been placed or confirmed.

In the event of a pricing error, we will notify you and provide the option to proceed at the corrected price or cancel the order. We are not obligated to honor incorrect pricing under any circumstance, regardless of whether payment has been processed.

By submitting payment, you represent and warrant that you are the authorized holder of the payment method used, that all billing information provided is accurate and complete, and that you authorize Maison Soire to charge the full order total — including applicable taxes, shipping, and any ancillary fees — to your payment method.

Promotional codes, discounts, and special pricing are non-transferable, cannot be combined unless explicitly stated, and may be revoked or modified at our sole discretion.

IV. Order Acceptance & Fulfillment

Your submission of an order constitutes an offer to purchase, not a binding contract. Maison Soire reserves the right to accept or decline any order at our sole discretion. An order confirmation email does not constitute acceptance — acceptance occurs only when the order has been shipped and tracking information has been provided.

We reserve the right to limit order quantities, refuse service to any individual or entity, and cancel orders that we believe, in our sole judgment, to be placed by resellers, unauthorized distributors, or bots.

Maison Soire shall not be liable for any delay in fulfillment or shipping resulting from circumstances beyond our reasonable control, including but not limited to supply chain disruptions, carrier delays, natural disasters, pandemics, government actions, labor disputes, or force majeure events.

V. Shipping & Risk of Loss

Title and risk of loss pass to the Customer upon delivery of the product to the shipping carrier. Maison Soire is not responsible for any loss, theft, damage, or delay that occurs after the product has been tendered to the carrier.

Estimated delivery timeframes are approximations only and are not guaranteed. Maison Soire shall not be held liable for any damages, costs, or losses arising from shipping delays or carrier performance.

It is the Customer's sole responsibility to provide a complete, accurate, and deliverable shipping address at checkout. We are not responsible for orders shipped to incorrect addresses due to Customer error, and no re-shipments, refunds, or credits will be issued in such cases.

VI. Refunds, Returns & Chargebacks

All purchases are governed by our Refund & Return Policy, which is incorporated into these Terms by reference. All sales are final. No returns, exchanges, or refunds will be issued except as expressly provided in that policy.

Initiating a chargeback, payment dispute, or bank reversal in an attempt to obtain a refund outside the terms of our Refund & Return Policy constitutes a material breach of these Terms. Maison Soire will contest all unauthorized chargebacks and reserves the right to pursue recovery of the disputed amount, associated chargeback fees and administrative costs, pursue collections through third-party agencies, suspend or permanently ban the Customer's account, and pursue any and all legal remedies available under applicable law.

VII. Intellectual Property

All content on this Site — including but not limited to text, graphics, photographs, logos, brand names, product names, taglines, page layouts, visual design, and source code — is the exclusive property of Maison Soire or its licensors and is protected by United States and international copyright, trademark, and intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Site for personal, non-commercial purposes only. You may not reproduce, distribute, modify, create derivative works from, publicly display, republish, download, store, scrape, or transmit any content from this Site without our prior written consent.

Any unauthorized use of our intellectual property may result in legal action, including claims for injunctive relief, statutory and actual damages, and attorney's fees.

Maison Soire does not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not warrant that any product will meet your specific expectations, preferences, or requirements beyond what is expressly described in the product listing.

XII. Limitation of Liability

XIV. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.

Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or invalidity thereof, shall be resolved exclusively through binding arbitration administered in Palm Beach County, Florida, in accordance with the rules of the American Arbitration Association. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

YOU HEREBY WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION. All claims must be brought in your individual capacity and not as a plaintiff or class member in any purported class, collective, or representative proceeding.

Notwithstanding the foregoing, Maison Soire reserves the right to seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of our intellectual property rights or other proprietary interests.

XV. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable by a court of competent jurisdiction, that provision shall be deemed severable and shall not affect the validity or enforceability of the remaining provisions, which shall continue in full force and effect.

XVI. Entire Agreement

These Terms, together with our Refund & Return Policy, Privacy Policy, and any other policies or guidelines published on the Site, constitute the entire agreement between you and Maison Soire regarding your use of the Site and purchase of products. These Terms supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.

No waiver of any provision of these Terms shall be deemed a further or continuing waiver of such provision or any other provision. Our failure to enforce any right or provision shall not constitute a waiver of that right or provision.
